Yes, with conditions. While California’s LVN regulations can seem conflicting, the governing statutes are clear: LVNs are permitted to work as independent contractors in private in‑home care when practicing under required physician or RN direction. The laws below establish this authority:

“The practice of vocational nursing… is practiced under the direction of a licensed physician and surgeon or registered nurse… A vocational nurse… engages in vocational nursing… for compensation or personal profit.”

“Private duty services are contracted directly between the nurse and the patient… A licensed vocational nurse (LVN) must provide private duty nursing services under the direction of a registered nurse… and/or the patient’s physician… The direction provided… must be available at least by telephone.”
